The truncated communication from Nyrstar clearly does not please the Financial Services and Markets Authority (FSMA) and the Antwerp public prosecutor's office confirms that an investigation is still ongoing, including searches at Nyrstar last fall.

This week, Le Vif is looking into the dismissal handed down in Brussels on March 5, not for lack of evidence despite a proper investigation, but solely due to a lack of resources in our judicial system to carry out the investigative steps: “the Brussels PJF does not have sufficient investigative capacity to carry out the investigation”. Thus, with no new information in the case, the court of appeal had no choice but to confirm the dismissal last March.
However, it is important to know that the very thorough investigation by the FSMA did result in the transfer of the case to the Antwerp public prosecutor's office, which confirmed to Vif this week that an investigation is indeed still ongoing, including searches that targeted Nyrstar last fall.
The FSMA Sanctions Commission is soon to rule on the fate of several directors (former and/or current), including former CEO Hilmar Rode.
